These Terms define the rules for using the Bagaha Live platform, the responsibilities of users and contributors, the scope of editorial control, and the liability protections and legal boundaries applicable to the service.

This page forms part of our public legal documentation for the Bagaha Live app and related website, which are owned and operated by Sagar Kumar Mazumdar.

These Terms & Conditions ("Terms") govern access to and use of the Bagaha Live mobile application, website, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
The Platform is owned and operated by Sagar Kumar Mazumdar under the brand name Bagaha Live.
1. Eligibility and Account Responsibility
You must be at least 18 years old to create an account, submit content, or post a local listing. You agree to provide accurate information, keep your login credentials secure, and remain responsible for activity that occurs through your account.
2. Reporter and User Submissions
If you submit articles, text, photos, videos, captions, tips, or other material, you remain solely responsible for that submission. You represent and warrant that:
- The material is truthful to the best of your knowledge and not misleading
- You own it or have all rights, permissions, and consents needed to submit it
- It does not violate privacy, publicity, copyright, trademark, or other third-party rights
- It does not contain unlawful, defamatory, abusive, hateful, fraudulent, or harmful content
Unless separately agreed in writing, reporters and contributors use the Platform as independent users and are not employees, agents, or legal representatives of Bagaha Live.
3. Guest Posts and Local Listings
The Platform may allow users to submit guest posts and local listings, including buy/sell posts, job posts, and property posts. These are user-submitted items. The person submitting the item is responsible for the accuracy, legality, rights, contact details, price, availability, and safety of that submission.
Bagaha Live may review, edit, approve, reject, hide, mark as filled or sold, or remove guest posts and local listings at its discretion. If a user needs deletion, status changes, or another action not available in the app, the user should contact admin support through the published contact channels.
Bagaha Live does not broker, verify, guarantee, insure, or take responsibility for local listing transactions, payments, delivery, employment terms, property documents, ownership, identity of parties, or offline meetings. Users must independently verify details before acting.
Local listings में misleading advance fee, deposit, OTP, UPI PIN, bank password, identity document, या sensitive information नहीं मांगी जा सकती. Job posts में false salary, placement, government job, या work-from-home claim नहीं होना चाहिए. Property posts में ownership, possession, documents, rent terms, brokerage, या legal status गलत नहीं लिखा जा सकता. Buy/sell posts में stolen, illegal, unsafe, fake, restricted, adult, या prohibited goods allowed नहीं हैं.
4. License to Use Submitted Content
By submitting content, you grant Bagaha Live a non-exclusive, worldwide, royalty-free license to host, store, reproduce, edit, translate, adapt, publish, distribute, display, promote, and archive that content for operating, improving, marketing, securing, and documenting the Platform and its journalism-related services.
5. Intermediary Status, Editorial Control, and Takedowns
Community guest posts and local listings are user-generated content. For those community features, Bagaha Live seeks to follow the obligations applicable to intermediaries under the Information Technology Act, 2000 and related rules. Editorial news content is separately reviewed and controlled by Bagaha Live. Nothing in these Terms is intended to claim an exemption that does not apply under law.
However, Bagaha Live maintains full editorial discretion to review, fact-check, edit, translate, reformat, publish, reject, unpublish, geo-block, archive, or remove any content at any time. In compliance with Rule 3(1)(d) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended, we will remove or disable access to specified unlawful information within three hours of receiving qualifying actual knowledge in the form prescribed by that rule, including a court order or a reasoned written intimation from a duly authorized government officer.
Further, in compliance with Rule 3(2)(b), if we receive a complaint regarding specified content depicting private areas, nudity or sexual conduct, or synthetic or manipulated content that impersonates an individual, we will take reasonable and practicable measures to remove or disable access to that content within two hours of receipt.
6. Prohibited Conduct
In accordance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you agree that you shall not host, display, upload, modify, publish, transmit, store, update or share any information on the Platform that:
- belongs to another person and to which you do not have any right;
- is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
- is harmful to children;
- infringes any patent, trademark, copyright, or other proprietary rights;
- violates any law for the time being in force;
- deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature;
- impersonates another person;
- threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offense, or prevents investigation of any offense, or is insulting other nations;
- contains software virus or any other computer code, file, or program designed to interrupt, destroy, or limit the functionality of any computer resource;
- is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity, or agency for financial gain or to cause any injury to any person;
- requests OTP, UPI PIN, bank password, unnecessary ID documents, or advance payment through deceptive listings.
- uses manipulated or synthetically generated media to impersonate, defraud, mislead, harass, or harm another person, or removes a disclosure label from synthetic media where the label is required by law.
We will periodically, and at least once every three months, remind users of these rules and the consequences of non-compliance. Depending on the issue and applicable law, we may remove content, suspend access, preserve evidence, or report an offence to the appropriate authority.
7. Intellectual Property
The Platform design, branding, logos, software, compilations, and editorial materials created by or for Bagaha Live are protected by intellectual property laws. Except as expressly allowed, you may not copy, republish, distribute, modify, sell, or commercially exploit those materials without prior written permission.
8. Advertising, External Links, and Sponsored Material
The Platform may display third-party advertisements, sponsored material, or links to external websites. Their content, claims, privacy practices, goods, and services are controlled by those third parties, not by Bagaha Live. Inclusion does not mean endorsement.
Advertisers must provide accurate, lawful, and substantiated claims and hold any licences, permissions, or approvals required for their products, services, offers, and promotional material. Sponsored placements are labelled where displayed. We may reject, restrict, or remove advertising at our discretion.
9. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of accuracy, completeness, fitness for a particular purpose, uninterrupted availability, non-infringement, and error-free operation.
10. Limitation of Liability
To the maximum extent permitted by law, Bagaha Live and its operators, editors, contributors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, reputation, data, or opportunity, arising from or relating to use of the Platform.
11. Indemnity
You agree to defend, indemnify, and hold harmless Bagaha Live, its operators, editors, affiliates, and service providers from claims, liabilities, damages, losses, penalties, and expenses arising out of your content, your breach of these Terms, your violation of law, or your infringement of another party's rights.
12. Suspension and Termination
We may suspend, restrict, or permanently terminate access to the Platform, and may preserve or remove content, where we believe it is necessary for policy enforcement, legal compliance, safety, abuse prevention, editorial decisions, or operational reasons.
13. Privacy, Grievance, and Legal Notices
Use of the Platform is also subject to our Privacy Policy and other published legal pages. Legal notices should be sent to bagahalive@gmail.com with enough detail to identify the issue and the affected content or account.
14. Force Majeure
We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, labor disputes, telecom failures, platform outages, cyber incidents, governmental actions, or infrastructure breakdowns.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, disputes arising from the Platform will be subject to the jurisdiction of courts having competent jurisdiction in India.
16. Severability and Survival
If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply. Provisions relating to licenses, intellectual property, disclaimers, liability limits, indemnity, archived content, and dispute handling survive termination.
17. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after revised Terms are posted means you accept the updated Terms.
